By Brooks provides creative services including photography, videography, creative direction, and production. We are based in the United Kingdom and operate in accordance with UK laws.

2. Services

All services are provided as per the terms set out in individual client agreements. These Terms of Service apply generally to anyone using our site or services and are intended to complement, not override, any specific written agreements.

3. Bookings & Payments

To confirm a booking, a 50% non-refundable deposit is typically required. The remaining 50% will be invoiced and is to be paid within 7 days of your session. The full payment schedule will be outlined in your project contract or invoice. Accepted payment methods include bank transfer and PayPal. No cash accepted. Late payments may incur interest under the Late Payment of Commercial Debts (Interest) Act 1998.

4. Cancellations & Rescheduling

All cancellations must be made in writing. Deposits are non-refundable unless otherwise stated. We will do our best to accommodate rescheduling requests, subject to availability. Rescheduling fees may apply.

5. Intellectual Property & Usage Rights

Unless otherwise agreed in writing:

• We retain the copyright to all creative content produced (photos, videos, etc.).

• Clients receive a licence to use the content as outlined in their project agreement — typically for personal or commercial use.

• Additional usage beyond what was agreed may require further licensing or fees.

We reserve the right to use any content we produce (including from paid projects, collaborations, or personal work) for promotional purposes, including on our website, portfolio, social media, and marketing material, unless otherwise agreed in writing.

6. Portfolio Content

Our website portfolio includes a mix of work created for clients, collaborative projects, and self-initiated personal work. Inclusion in the portfolio:

• Does not necessarily indicate a paid or commercial relationship.

• Is intended to showcase creative capabilities.

• Does not imply endorsement or sponsorship by individuals or brands shown.

7. Client Responsibilities

Clients are responsible for providing accurate information, necessary permissions (e.g., property or model releases), and timely access to locations or assets required for the shoot. Delays or complications arising from a lack of cooperation or information may affect deadlines or incur additional charges.

8. Delivery & Revisions

Delivery timelines will be outlined in your project agreement. Standard projects include a specific number of revisions; additional edits may be charged at our standard hourly or project rate. Final files are delivered digitally unless otherwise agreed.

9. Limitation of Liability

While we take every reasonable step to ensure high-quality service and results, we shall not be liable for:

• Circumstances beyond our control (e.g., weather, illness, equipment failure).

• Indirect or consequential loss, including loss of business, revenue, or data.

• Damage to or loss of digital files after delivery.

Our maximum liability is limited to the total amount paid for the applicable service.

10. Website Use

By using our website, you agree not to:

• Copy or reuse content without our permission.

• Attempt to breach security or access restricted areas.

• Post or transmit any harmful, unlawful, or defamatory content.

We reserve the right to restrict or terminate access at our discretion.
